On April 20, the Equal Employment Opportunity Commission published a proposed rule that would amend the regulations and interpretive guidance implementing Title I of the Americans with Disabilities Act. Congress enacted the ADA in 1990 to prohibit discrimination against individuals with disabilities, and the EEOC issued implementing regulations in 1991 to provide additional guidance on the law's requirements and prohibited practices with respect to employment. This proposed rule is the first formal guidance that the EEOC has provided since 1991 and, in general, provides guidance on the extent to which the ADA permits employers to offer incentives to employees to participate in wellness programs.
